The Commissioner for Civil Service Supervision, Pranvera Strakosha, has requested that the law be amended for dismissed civil servants who win court cases, so that their opinion regarding their appointments to an equivalent position is not taken away.

She stated that employees do not give their consent regarding new appointments, adding that "they stay at home and receive their money and may have been employed elsewhere."

Strakosha emphasized that there have been cases when the case was being tried and the job no longer existed after the institution went through a restructuring process.

"In 2024, there were 189 decisions to be executed, of which 55 were executed and 134 remained unexecuted, they are on the waiting list, they are being paid. We have also established joint Commissions and with DAP, we have also participated in the Commissions. The majority were objectively unable to be appointed, as we found that they do not consent to move to an equivalent position and receive the money," said Strakosha. 

According to a report by the Supreme State Audit Office, Albanian taxpayers pay an average of 20 million euros per year to compensate those who are dismissed from their jobs in the administration. 

"They stay at home and take the money and maybe they could be employed somewhere else. This is the problem, Article 66/1 is an obstacle, it's not that it gives the institution the right, where it says you were a director here or a head of sector, you meet the criteria as a lawyer or economist, you will go here as a head of sector, the institution does not have the freedom," Strakosha continued. 

According to her, even in those cases where DAP has attempted to appoint them, after we have said "ok", the dismissed employees do not give their consent without reasonable grounds.

"They did not accept, they went to court and the court did not accept the act. There will necessarily be legal intervention. They were told to go to the place they were, but at the moment the case was being judged, the workplace no longer existed as the institution went through a restructuring process," she said. 

According to the Commissioner, the restriction on taking the opinion of a civil servant should be removed and only the restriction of the law should be imposed.
