
We have such a situation - the owner of a pharmaceutical company, Nadir Çausholli, creates two other companies, “Medex Albania” and “Pharma Plus”. To hide his tracks, he establishes these companies in the name of his subordinates and uses them to issue fictitious invoices, in order to obtain reimbursement from the Health Insurance Fund.
The Tirana Prosecutor's Office says that Çausholli's "fictitious" companies sold "Foster" and "Trimbow" medications to the entity "CFO Pharma", for which another company, "Medicamenta", has the exclusivity.
The prosecution also says that Çausholli was helped by the former head of the Health Care Fund, Spartak Zekja, and several other employees of the public institution, Zade Mali, Esjana Gjishti and Romina Agalliu, to falsify the documents.
The value of the suspected illegal monetary gain is currently estimated at 70 million new lekë, while previously published suspicions speak of a figure reaching up to 60 million euros.
So, everything seems clear. At the center of the alleged fraudulent scheme is "CFO Pharma" and its owner, Nadir Çausholli.
But, when it comes to the application of security measures, all responsibility is transferred to the administrator of "CFO Pharma", Frigul Milla, a subordinate of Nadir Çausholli.
The Law on “Commercial Companies” stipulates that the administrator of private entities is primarily responsible for the daily activities of the company, including keeping the books of sales and purchases. The administrator is accountable to the partner or the assembly of partners.
In the status of the company "CFO Pharma", the administrator "carries out all administrative actions of the company's commercial activity, implementing the commercial policies established by the partner".
In this specific case, administrator Frigul Milla appears to have implemented precisely the "commercial policies established by partner" Nadir Çausholli.
The sole partner of "CFO Pharma" has created two "fictitious" companies, as the Prosecution itself admits, while the administrator has "implemented Çausholli's policy" to make unreal invoices to those two entities.

For his suspicious actions, administrator Frigul Milla is already under the security measure "prison arrest" in absentia. With lighter security measures, "obligation to appear" and "ban on leaving the country" are also Çausholli's three subordinates: Lorena Ballabani, who is the "de facto" owner of the entity "Medex Albania"; Alba Zylfo, who is registered as the "de facto" owner of "Pharma Plus", as well as Jona Berberi.
